{"id":4999,"date":"2013-04-05T15:33:18","date_gmt":"2013-04-05T14:33:18","guid":{"rendered":"http:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=4999"},"modified":"2016-02-05T10:53:00","modified_gmt":"2016-02-05T10:53:00","slug":"high-court-controversially-finds-council-within-its-powers-to-withhold-sites-from-neighbourhood-forum-setting-significant-precedent-in-a-largely-untested-area-of-law","status":"publish","type":"page","link":"https:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=4999","title":{"rendered":"High Court controversially finds Council \u00e2\u20ac\u02dcWithin Its Powers\u00e2\u20ac\u2122 to withhold sites from Neighbourhood Forum"},"content":{"rendered":"<h1><b><a href=\"http:\/\/www.localgovernmentlawyer.co.uk\/index.php?option=com_content&amp;view=article&amp;id=13536:council-qwithin-its-powersq-to-withhold-key-sites-from-neighbourhood-forum&amp;catid=1:latest-stories\" target=\"_blank\">Ref. <\/a><em>Daws Hill Neighbourhood Forum &amp; Ors, R (on the application of) v Secretary of State for Communities and Local Government &amp; Anor<\/em> [2013] EWHC 513<\/b><\/h1>\n<p><span style=\"color: #000000;\">In a case that promises to now move on to the Court of Appeal, the High Court has adjudged Wycombe District Council to have been within their powers to exclude from consideration by a Neighbourhood Forum two sites with development potential. <\/span><\/p>\n<p><span style=\"color: #000000;\">Despite protestations from the Daws Hill Neighbourhood Forum (DHNF) that excluding these sites left them with an \u00e2\u20ac\u0153artificially reduced rump area\u00e2\u20ac\u009d of already developed residential housing and an \u00e2\u20ac\u0153effectively meaningless\u00e2\u20ac\u009d forum, the High Court sided with the council in its interpretation of the Town and Country Planning Act 1990 and the Localism Act 2011.<\/span><\/p>\n<p><span style=\"color: #000000;\"><img decoding=\"async\" class=\"alignright size-medium wp-image-4735\" src=\"http:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/001-300x187.jpg\" alt=\"Daws Hill Neighbourhood Forum width=\" height=\"187\" srcset=\"https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/001-300x187.jpg 300w, https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/001.jpg 847w\" sizes=\"(max-width: 300px) 85vw, 300px\" \/><\/span><span style=\"color: #000000;\">Mr Justice Supperstone said that section 61G(5) of the Town and Country Planning Act <\/span><span style=\"color: #000000;\">1990, as inserted by the 2011 Act, required a local planning authority in determining an application for a neighbourhood area to consider whether the proposed area was appropriate.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00e2\u20ac\u0153The discretion given to the authority is a broad one. The exercise of discretion turns on the specific factual and policy matrix that exists in the individual case at the time the determination is made.\u00e2\u20ac\u009d<\/span><\/p>\n<p><span style=\"color: #000000;\">In his mind, the council appropriately had regard to the specific circumstances that existed at the time the decision was made to exclude the sites. Their reasons included the sites\u00e2\u20ac\u2122 strategic nature; the wide communities of interest, which were greater than the immediate Daws Hill area, the timing (as plans and applications for the sites were well advanced) and the other opportunities that existed for the local community to input to the planning of the two sites.<\/span><\/p>\n<p><span style=\"color: #000000;\">In a statement, the local authority is reported as commenting:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00e2\u20ac\u0153Wycombe District Council acted in good faith to interpret this complex and new area of law. We sought legal advice before deciding to exclude the key sites which the forum proposed within their neighbourhood plan.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00e2\u20ac\u0153Our duty is to work with local residents to help them establish a neighbourhood forum but also to fulfil our role to act in the wider interest of the district and, as the local planning authority, to find the right balance applying national planning policies and guidelines.&#8221;<\/span><\/p>\n<p><span style=\"color: #000000;\">As yet, this is still a new and largely untested area of the law and with the DHNF\u00e2\u20ac\u2122s lawyers now writing for permission to appeal to the Court of Appeal, this first episode seems far from over.
