Sims v Dacorum Borough Council [2013] EWCA Civ 12<\/i><\/b><\/p>\n<p><span style=\"color: #000000;\">The Court of Appeal has<\/span> now<span style=\"color: #000000;\"> passed final judgement on a case that was the first to challenge the rule of <i>Monk\u00e2\u20ac\u2122s <\/i>compatibility with two articles of the European Convention on Human Rights. The judgement provides an important new precedent in UK housing law.<\/span><\/p>\n<p><span style=\"color: #000000;\">Primarily in question here was the rule laid down in <em>Hammersmith LBC v Monk<\/em> (1992)<i>(\u00e2\u20ac\u02dcMonk\u00e2\u20ac\u2122<\/i>), by which a joint tenant can, without recourse to other joint tenants, end their joint tenancy by serving his or her landlord with a notice to quit.<img loading=\"lazy\" decoding=\"async\" class=\"alignright  wp-image-4364\" alt=\"Tenant Property\" src=\"http:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/Chagford-300x225.jpg\" width=\"270\" height=\"203\" srcset=\"https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/Chagford-300x225.jpg 300w, https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/Chagford-1024x768.jpg 1024w\" sizes=\"auto, (max-width: 270px) 85vw, 270px\" \/><\/span><\/p>\n<p><span style=\"color: #000000;\">Mr and Mrs Sims had been the joint, secure tenants of a property owned by Dacorum Borough Council (\u00e2\u20ac\u0153the Council\u00e2\u20ac\u009d). The couple separated in 2010 and Mrs Sims left the home. She was eventually re-housed by a different local authority, but not until she had served a notice to quit on the Council in June the same year.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mr Sims made an application to the Council to remain as the property\u00e2\u20ac\u2122s sole tenant, but his application was rejected and possession proceedings issued by the Council on 28 October 2010.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mr Sim\u00e2\u20ac\u2122 defence alleged that his wife\u00e2\u20ac\u2122s notice to quit was invalid, that his eviction from the property would breach his rights under Article 8 of the Convention and that, in any event, the rule in <em>Monk<\/em> was incompatible with Article 8.<\/span><\/p>\n<p><span style=\"color: #000000;\">Despite presiding Deputy DJ Wood, at Watford County Court, handing down a rejection of Mr Sims\u00e2\u20ac\u2122 arguments and making an order for possession of the property, Mr Sims obtained permission to appeal the order and \u00e2\u20ac\u0153leapfrogged\u00e2\u20ac\u009d to the Court of Appeal.<\/span><\/p>\n<p><span style=\"color: #000000;\">The Court of Appeal considered only one argument from Mr Sims, that:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00e2\u20ac\u0153The judge was wrong in law in deciding that the service of a notice to quit by one joint tenant was effective to terminate a joint secure tenancy. This breaches the appellant\u00e2\u20ac\u2122s rights under Article 8 and\/or article 1 of the First Protocol of the European Convention on Human Rights.\u00e2\u20ac\u009d<\/span><\/p>\n<p><span style=\"color: #000000;\">Under the doctrine of binding precedent, the Court of Appeal remained bound by the superior House of Lords to accept the rule laid out in <i>Monk <\/i>and reject the appeal. The only question remaining, therefore, was whether to refer the case to the Supreme Court (previously the House of Lords itself; which could potentially <i>overrule Monk<\/i>).<\/span><\/p>\n<p><span style=\"color: #000000;\">Mr Sims representatives argued that, in light of Strasbourg and domestic jurisprudence continually growing in importance, the Court was obligated to develop the common law, ensuring that <em>Monk<\/em> did not interfere unduly with his right to respect for his home (Article 8) and\/or his right to freedom from state interference with his property rights (the Protocol).<\/span><\/p>\n<p><span style=\"color: #000000;\">The Court of Appeal dismissed these arguments on the grounds that neither Article 8 nor Article 1 (First Protocol) were engaged by the facts of the case. For Article 8, the Court reinforced that the purpose of the Article was not to protect property or contractual rights, but rather to uphold an individual\u00e2\u20ac\u2122s right to respect for his home per se; a right already protected in domestic law by the former tenant\u00e2\u20ac\u2122s ability to argue that an eviction would not be proportionate (i.e. the \u00e2\u20ac\u0153Pinnock proportionality\u00e2\u20ac\u009d defence).<\/span><\/p>\n<p><span style=\"color: #000000;\">As for Article 1 of the First Protocol, there had been no interference with Mr Sims\u00e2\u20ac\u2122 rights because Mrs Sims had merely exercised the right enjoyed by both of them to end their joint tenancy of the property.<\/span><\/p>\n<p><span style=\"color: #000000;\">Mummery LJ concluded:<\/span><\/p>\n<p><span style=\"color: #000000;\">\u00e2\u20ac\u0153There is no incompatibility between the rules of English property and contract law relating to the termination of a joint tenancy by one joint tenant and the ECHR. I cannot think of a sensible purpose that would be served by the expenditure of yet more public funds (on both sides) on a repeat of this debate before five (or even more) Justices of the Supreme Court of the United Kingdom.\u00e2\u20ac\u009d<\/span><\/p>\n<p><span style=\"color: #000000;\">The Court\u00e2\u20ac\u2122s judgment should end all speculation about a possible intervention of European Convention rights in possession orders, which will no doubt be welcome to many Landlords.
