Buyers Beware of Fleecehold!\u00a0<\/strong><\/p>\n<p>The need for the services of a specialist property solicitor has never been greater.<\/p>\n<p>The term \u2018fleecehold\u2019 has been coined to cover a rising phenomenon in house purchasing.\u00a0 The situation has arisen, particularly, with the rise of new build estates where private companies have retained the management rights.<\/p>\n<p>Purchasers are buying what they think is the freehold to a property, only to discover stringent and costly clauses in that freehold.<\/p>\n<p>Traditionally, properties have been sold as either Freehold or Leasehold.\u00a0 The punning so-called \u2018Fleecehold\u2019 is a mongrel hybrid and buyers need to look carefully at the small print.<\/p>\n<p><strong>Definition of Terms<\/strong><\/p>\n<p><strong>Freehold:<img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-29876 alignright\" src=\"https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/Islington-London-communal-garden-300x136.jpg\" alt=\"\" width=\"300\" height=\"136\" srcset=\"https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/Islington-London-communal-garden-300x136.jpg 300w, https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/Islington-London-communal-garden-768x347.jpg 768w, https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/Islington-London-communal-garden.jpg 1200w\" sizes=\"auto, (max-width: 300px) 85vw, 300px\" \/><\/strong><\/p>\n<p>The buyer purchases ownership of the property and of the land it is built on.\u00a0 The buyer is responsible for all maintenance and repair and has autonomy over the property.<\/p>\n<p><strong>Leasehold:<\/strong><\/p>\n<p>The buyer owns the property but not the land on which it stands.\u00a0 This is particularly common with flats and apartments.\u00a0 The landowner has the right to charge the leaseholder fees to cover costs for such things as maintenance of communal areas, lifts, garden space, walkways etc.\u00a0 These charges, along with terms and conditions of residence and purchaser\u2019s rights, are specified in the purchaser\u2019s lease.\u00a0 The potential cost implications should be carefully considered when taking on a property.<\/p>\n<p><strong>\u2018Fleecehold\u2019<\/strong>:<img loading=\"lazy\" decoding=\"async\" class=\"wp-image-18572 alignright\" although the owner purchases both the land and the\u00a0property, the deeds specify the right for, typically, a third party such as a property management company to impose fees or service charges for specific maintenance works.\u00a0 These might, as for a leaseholder, include maintenance of communal areas such as parks, playgrounds and private roads.\u00a0 To all intents and purposes, a management fee.<\/p>\n<p>The devil is in the detail \u2013 and the inability for the \u2018fleeceholder\u2019 to control increases in the fees to which they are contractually committed.<\/p>\n<p><strong><img loading=\"lazy\" decoding=\"async\" class=\"alignnone size-medium wp-image-29877\" src=\"https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/Windows-in-London-Office-Block-n-300x169.jpg\" alt=\"\" width=\"300\" height=\"169\" \/><\/strong><\/p>\n<p><strong>Property Management Companies<\/strong><\/p>\n<p>As the name suggests, originally, these were set up on behalf of property owners to:<\/p>\n<ul>\n<li>manage financial matters such as the collection of ground rent and maintenance funds; organise upkeep of the property\u2019s common areas;<\/li>\n<li>ensure compliance with legal standards;<\/li>\n<li>resolve disputes among residents or related to property usage.<\/li>\n<\/ul>\n<p>However, many fleeceholders and leaseholders have found themselves vulnerable to the \u2018licence to print money\u2019 offered by their contracts.<\/p>\n<p>The most obvious issue is their lack of control over increases to the cost of the service charge or the decisions made by the management company.<\/p>\n<p>This anxiety is often aggravated by lack of clarity or detail as to how the money is used and the poor quality of the services provided, including inadequate workmanship.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/westminster-houses-of-parliment-1.png 1200w\" sizes=\"auto, (max-width: 300px) 85vw, 300px\" \/><\/p>\n<p><strong>Government Response<\/strong><\/p>\n<p>In March 2024 the plight of fleeceholders was flagged by Conservative peer Lord Moylan, ex-adviser to Boris Johnson.\u00a0 There were rising numbers of cases where financially stricken councils were approving plans new build estates in which roads, gardens and play areas,\u00a0 even street lighting, etc came under the remit of the construction company as \u2018estate fees\u2019.<\/p>\n<p>Lord Moylan blamed local councils for abdicating their responsibilities claiming \u2018&#8221;They will accept the additional council tax that is generated by the new properties but they will not take on the responsibilities for maintaining those common amenities,&#8221;\u2019<\/p>\n<p>Some 40% of new builds across Britain had been constructed on the private estates model.<\/p>\n<p>The Competition and Markets Authority, which revealed that some companies had doubled their fees within a year, recommended ending this practice and forcing local councils to adopt responsibility for public amenities on new housing estates.<\/p>\n<p>In January 2026, the BBC reported on the subject identifying a number of cases across the country.\u00a0 One construction company, Persimmon Homes, said local authorities across the country were &#8220;no longer adopting new housing developments in full&#8221; which had led to the use of management companies.<\/p>\n<p>The current government recognises that up to 1.75 million homes could be affected.<\/p>\n<p>I said at the beginning, buyer, beware.\u00a0 But if all the available properties for sale locally are part of a such private estates, what can a desperate buyer do?<\/p>\n<p>One resident suffering under a fleecehold described himself as feeling like a \u2018cash cow\u2019 for the company managing his property.<\/p>\n<p><strong>\u00a0<\/strong><\/p>\n<p>\u00a9<a
