Kuwait&#8217;s investment fund, which owns the nearby Willis building through its property company St Martins Property, claims the new skyscraper will &#8220;materially reduce the light&#8221; coming through windows in its building, creating &#8220;substantial interference&#8221; that amounts to a legal nuisance.<\/p>\n<p class=\"whitespace-normal break-words\">This is not just about a bit less sunshine, but about protecting a valuable property investment and the legal &#8220;Right to Light&#8221; that comes with owning buildings in densely-packed cities like London.<\/p>\n<h5 class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\">Right to Light<\/h5>\n<p class=\"whitespace-normal break-words\">In English law, property owners can claim a &#8220;Right to Light&#8221; if they&#8217;ve enjoyed natural light through their windows for at least twenty years. This ancient legal principle protects buildings from being plunged into darkness by new developments.<\/p>\n<p class=\"whitespace-normal break-words\">The Willis building, completed in 2008 and home to insurance giant Willis Towers Watson, sits just a few minutes&#8217; walk from the new tower. Its owners argue they have the legal right to keep their current level of natural light.<\/p>\n<p class=\"whitespace-normal break-words\">This case highlights the ongoing tension in London&#8217;s financial district, where every new skyscraper potentially blocks light from existing buildings. It has:<\/p>\n<ul class=\"[&amp;:not(:last-child)_ul]:pb-1 [&amp;:not(:last-child)_ol]:pb-1 list-disc space-y-1.5 pl-7\">\n<li class=\"whitespace-normal break-words\"><strong>36 storeys<\/strong>\u00a0of mixed-use office space<\/li>\n<li class=\"whitespace-normal break-words\"><strong>62,000 square metres<\/strong>\u00a0of office space<\/li>\n<li class=\"whitespace-normal break-words\"><strong>Panoramic views<\/strong> over Tower Bridge, the Tower of London, and the South Bank<\/li>\n<li class=\"whitespace-normal break-words\"><strong>Low carbon design<\/strong> &#8211; planned to be one of the UK&#8217;s most environmentally friendly office towers<\/li>\n<li class=\"whitespace-normal break-words\"><strong>Completion date<\/strong>: 2028<\/li>\n<li class=\"whitespace-normal break-words\"><strong>Current status<\/strong>: Pre-construction phase<\/li>\n<\/ul>\n<p class=\"whitespace-normal break-words\">The tower received planning permission five years ago and sits on over an acre of prime London real estate at the southern edge of the City&#8217;s main cluster of skyscrapers.<\/p>\n<p class=\"text-xl font-bold text-text-100 mt-1 -mb-0.5\">The loss of natural light could significantly reduce the value and attractiveness of a building. Tenants pay premium rents for bright, naturally lit office spaces.<\/p>\n<p class=\"whitespace-normal break-words\">A legal dispute could halt construction or force expensive design changes. The project represents a massive investment in London&#8217;s commercial property market.<\/p>\n<p class=\"whitespace-normal break-words\">The case could set important precedents for future skyscraper developments in the increasingly crowded financial district.<\/p>\n<p class=\"whitespace-normal break-words\">In 2016, the developers of 22 Bishopsgate faced a similar claim. That dispute was resolved when the City of London Corporation stepped in to provide compensation to the affected property owner.
