{"id":20187,"date":"2018-06-26T11:41:50","date_gmt":"2018-06-26T10:41:50","guid":{"rendered":"http:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=20187"},"modified":"2020-07-08T14:55:23","modified_gmt":"2020-07-08T13:55:23","slug":"1-15-million-households-waiting-for-social-housing-2","status":"publish","type":"page","link":"https:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=20187","title":{"rendered":"Fraudulent sales of property"},"content":{"rendered":"<p><em>Conjoined Appeal in Court of Appeal on Fraudulent Sale of Properties:<br \/>\n<\/em><em>P&amp;P Property Ltd v Owen White &amp; Catlin LLP ;<br \/>\n<\/em><em>Dreamvar (UK) Limited v Mishcon de Reya;<\/em><\/p>\n<p><em>An Important ruling by the Court of Appeal regarding the question of responsibility for Estate Agents and Solicitors \/ Conveyancers for both vendors and purchasers and following fraudulent sales of property.\u00c2\u00a0 Both rulings were overturned, thus setting a new precedent.<\/em><\/p>\n<p>Following the sale of 2 different million pound plus properties where the vendors did not possess the ownership rights, an important principle has been established by the Court of Appeal regarding responsibility for insufficient due diligence.<\/p>\n<p>In Dreamvar V Mishcon de Reya, de Reya acting as purchaser\u00e2\u20ac\u2122s solicitors was held liable for a loss of over \u00c2\u00a31.1 million suffered by Dreamvar even though the fraudulent vendor\u00e2\u20ac\u2122s solicitor who was also also sued was not deemed to be at fault.<\/p>\n<p>By contrast, in P &amp; P Property Ltd v Owen White &amp; Catlin LLP, the seller\u00e2\u20ac\u2122s solicitor was was held liable for not applying the appropriate level of due diligence and therefore negligently enabling the fraud to proceed.<\/p>\n<p>As a result of these rulings, the position appears to be that the vendor\u00e2\u20ac\u2122s and purchaser\u00e2\u20ac\u2122s conveyancors \/ solicitors have partial responsibility for not passing the money for the purchase of the property over to a fraudulent vendor. Both the parties previously found solely reliable are no doubt relieved.
