The legislation will be introduced in the Finance Bill 2017-18.<\/p>\n<p>From 1st January 2018, there will be no relief in chargeable gains by companies on &#8216;assets&#8217;, including rental properties. The change is likely to affect the buy-to-let market and at the same time raise significant revenue for the government, which is expected to earn an additional \u00c2\u00a31.24 billion over the course of this parliament.<\/p>\n<p>Currently, an individual buying a rental property that rises in value, will pay 28% of the price rise in Capital Gains Tax (CGT) when it is sold. So, if a rental property is bought for \u00c2\u00a3100,000 and sold ten years later for \u00c2\u00a3200,000, \u00c2\u00a328,000 CGT is payable.<\/p>\n<p>However, a company buying and selling the same property for the same price could deduct the amount of the price rise that was due to inflation, before paying CGT. So, if a company bought the rental property for \u00c2\u00a3100,000 and sold it ten years later for \u00c2\u00a3200,000, and inflation over the ten year period was 3%, inflation would have accounted for \u00c2\u00a334,000 of the price rise. This could then be deducted from the \u00c2\u00a3100,000 profit before applying the 28% CGT, and only \u00c2\u00a318,480 is payable.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-19129 alignnone\" src=\"http:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/CGT-table-300x74.png\" alt=\"\" width=\"689\" height=\"170\" srcset=\"https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/CGT-table-300x74.png 300w, https:\/\/www.propertysurveying.co.uk\/newsletter\/wp-content\/uploads\/CGT-table.png 750w\" sizes=\"auto, (max-width: 689px) 85vw, 689px\" \/><\/p>\n<p>The discrepancy will now be withdrawn, although it will only affect price rises from January 2018 so companies will not lose any benefit they have already gained.<\/p>\n<p>The removal of the tax advantage is aimed at giving owner-occupiers the opportunity to buy their home on a \u00e2\u20ac\u02dclevel playing field\u00e2\u20ac\u2122 with buy to let landlords.<\/p>\n<p><a href=\"http:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=19061\">Back to December 2017 Newsletter<\/a><\/p>\n<p>\u00c2\u00a9 <a href=\"http:\/\/www.propertysurveying.co.uk\/INDEX\/INDEX1.html\">www.PropertySurveying.co.uk<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>After April\u00e2\u20ac\u2122s stamp duty surcharge, the Autumn Budget delivered yet more bad news for buy to let landlords, in the form of an indexation allowance freeze.
