{"id":18850,"date":"2017-10-25T10:00:51","date_gmt":"2017-10-25T09:00:51","guid":{"rendered":"http:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=18850"},"modified":"2020-07-08T14:56:36","modified_gmt":"2020-07-08T13:56:36","slug":"april-2018-government-legislation-changes-hmos-epcs","status":"publish","type":"page","link":"https:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=18850","title":{"rendered":"April 2018 government legislation changes to HMOs and EPCs"},"content":{"rendered":"<p>Spring 2018 brings with it changes to Government legislation on Houses of Multiple Occupation and Energy Performance Certificates in rented accommodation.<\/p>\n<p><strong>HMO Legislation changes<\/strong><\/p>\n<p>The Government is proposing changes to take effect in spring 2018, that will increase the number of properties that are subject to licensing. These include:<\/p>\n<ul>\n<li>the removal of the three-storey rule;<\/li>\n<li>the inclusion of flats that are located above \/ below commercial premises;<\/li>\n<li>a minimum room size requirement of 6.52 sq.m, in line with the current standard for overcrowding (<em>Housing Act 1985)<\/em>. This is likely to be 10 sq.m for HMOs in which tenants have their own bathroom but share other facilities i.e, a kitchen.<\/li>\n<\/ul>\n<p><strong>Energy Performance Certificate \u00e2\u20ac\u201c Minimum Level of Energy Efficiency changes<\/strong><\/p>\n<p>There is no obligation to obtain an Energy Performance Certificate (EPC) on a bedsit or a room\u00c2\u00a0in a house in multiple occupation (HMO) that is not self-contained.<\/p>\n<p>However, if\u00c2\u00a0the property was bought within the past\u00c2\u00a0ten years or was previously rented out on a whole-property basis, it may have an EPC covering the property as a\u00c2\u00a0whole.<\/p>\n<p>From 1st April\u00c2\u00a02018, if the property has an EPC rating of F or G, the owner\/landlord will not be able to issue new tenancies for non-self-contained units, until steps are taken to comply with new regulations.
