This obligation often carried down through the ownership of the land. The Chancel Tax is usually on property or land holdings that were once Glebe or Church owned lands.<\/p>\n<p><strong>What is the likelihood of the property I am investigating being affected?<\/strong><\/p>\n<p style=\"text-align: justify;\">If it was on land that was owned by the church, was close to the church or was gifted by the church, then it is possible.<\/p>\n<p style=\"text-align: justify;\">The most famous case in recent times was regarding an unfortunate couple near Stratford upon Avon who had to fund a repair and pay the costs of the legal challenge &#8211; a cost of nearly \u00c2\u00a3500,000.<\/p>\n<p><strong>How do I know if the property I am investigating is affected by chancel tax?<\/strong><\/p>\n<p style=\"text-align: justify;\">A detailed search of any old deeds is required.\u00c2\u00a0 It may not be possible to find information in the deeds that are available.\u00c2\u00a0 You would still be liable even if you searched and there was no evidence of the covenant or deed in all the paperwork that you examined.\u00c2\u00a0 It may be possible in some circumstances for the liability to be passed back to the vendor.<\/p>\n<p><strong>What if I do not know if it is affected \u00e2\u20ac\u201c what can we do?<\/strong><\/p>\n<p style=\"text-align: justify;\">The only practical thing to do is take out insurance<\/p>\n<p><strong>How much will this cost?<\/strong><\/p>\n<p style=\"text-align: justify;\">This will vary according to the underwriters\u00e2\u20ac\u2122 opinion but typically this may be in the region of \u00c2\u00a3100 to \u00c2\u00a3200.<\/p>\n<p><strong>How long will this last for?<\/strong><\/p>\n<p style=\"text-align: justify;\">The liability will last for ever and the insurance will last for as long as the policy states.\u00c2\u00a0 Most state a finite number of years.<\/p>\n<p><strong>Where do I get the insurance for Chancel Tax Protection from?<\/strong><\/p>\n<p style=\"text-align: justify;\">Via your solicitor or alternatively via a search on the world wide web which will lead to a number of insurance brokers and companies offering insurance schemes.<\/p>\n<p><strong>What can we do if we live in a property and that is affected?<\/strong><\/p>\n<p style=\"text-align: justify;\">The choices are either:<\/p>\n<ul>\n<li style=\"text-align: justify;\">Sell the property,<\/li>\n<li style=\"text-align: justify;\">Negotiate a deal with the diocese to be released from the obligation,<\/li>\n<li style=\"text-align: justify;\">Pay the obligation.<\/li>\n<\/ul>\n<p><strong>Isn\u00e2\u20ac\u2122t the Law going to change ?<\/strong><\/p>\n<p style=\"text-align: justify;\">Yes.
