{"id":11624,"date":"2015-01-19T17:51:36","date_gmt":"2015-01-19T16:51:36","guid":{"rendered":"http:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=11624"},"modified":"2015-09-11T15:43:20","modified_gmt":"2015-09-11T15:43:20","slug":"new-fund-made-available-to-local-councils-in-a-bid-to-prevent-unauthorised-development","status":"publish","type":"page","link":"https:\/\/www.propertysurveying.co.uk\/newsletter\/?page_id=11624","title":{"rendered":"New fund made available to local councils in a bid to prevent unauthorised development"},"content":{"rendered":"<h3>The 10<sup>th<\/sup> January 2015 saw Communities Secretary, Eric Pickles announce that in a bid to crack down on unauthorised development, a new \u00c2\u00a31million fund will be made available to local councils.<\/h3>\n<p>Up until now, the cost of seeking court injunctions against those who flout planning law, has been settled by the local council. However, with the introduction of the new Planning Enforcement Fund, this no longer needs to be the case.<\/p>\n<p>A recent survey of councils highlighted that the average cost of an injunction during 2011 \u00e2\u20ac\u201c 2013 was around \u00c2\u00a313,000, but with the new \u00c2\u00a31million fund in place, councils will be able to apply for \u00c2\u00a310,000 per case, enabling them to effectively take action against any unauthorised development.<\/p>\n<p>Mr Pickles explains:<\/p>\n<p><em>\u00e2\u20ac\u0153This new \u00c2\u00a31 million fund gives councils the tools they need in the fight against unauthorised development, so they should not be afraid to go through the courts to tackle serious breaches of planning law\u00e2\u20ac\u009d<\/em><\/p>\n<p>He goes on to say:<\/p>\n<p><em>\u00e2\u20ac\u0153Councils should not be afraid of using court injunctions for serious planning breaches and this new \u00c2\u00a31 million enforcement fund gives councils extra resources in the fight against unauthorised development\u00e2\u20ac\u009d<\/em><em>\u00c2\u00a0<\/em><\/p>\n<p>The \u00c2\u00a31million fund will be split, with \u00c2\u00a3200,000 being available to local councils until March 2015 and \u00c2\u00a3800,000 being made available in the 2015-16 financial year.<em>\u00c2\u00a0<\/em><\/p>\n<p>This is not the only change that the current government has made in an attempt to deal with unlawful developments.
